1. GENERAL INFORMATION

Kaymack DOO (hereinafter: “Kaymack”) is a limited liability company (LLC) registered in the Business Registers Agency of the Republic of Serbia, with registered address at Radnička 16, 21000 Novi Sad, Serbia, Tax Identification Number (PIB): 115654105, Registration Number (MB): 22188968.

Our primary purpose is to connect employers from around the world who offer remote positions with job candidates based in Serbia. Our mission is to enable Serbian talent to cross geographical boundaries and find remote employment opportunities worldwide.

2. INTRODUCTORY PROVISIONS

These General Terms and Conditions of Use (hereinafter: “Terms”) set out the conditions and rules applicable to visitors of our website and registered platform users, including job candidates (hereinafter: “Candidates”) and employers (hereinafter: “Employers”) (collectively referred to as: “User”) when using our website and other services provided through our website.

The User acknowledges that these Terms apply in the same manner as any other agreement in written form.

By using our website, the User confirms that they are familiar with and agree to these Terms, as well as all other rules and obligations governing the use of our website and the services provided through it.

If you do not agree with the stated Terms, please discontinue visiting our website and using our programs and services.

3. PROTECTION OF PERSONAL DATA AND USER PRIVACY

In the course of using our platform, Kaymack processes your personal data. In this regard, Kaymack is deeply committed to the protection of human rights, including the protection of personal data and privacy of Users (job candidates), representatives of Users (employer representatives), and visitors to the website.

4. SERVICES WE PROVIDE

Our services consist of assisting Employers in selecting the best-suited Candidates. Information about the services we offer can be found on our website at kaymack.careers.

The User is obliged to provide accurate, complete, and valid information during the registration process on our website.

During registration, the use of names, nicknames, and titles that are the property of third parties is not permitted, nor is the use of data that is unlawful, harmful, threatening, abusive, harassing, defamatory, or in any way harmful to children, minors, or any third parties.

5. PRICING

Kaymack offers two categories of services, each with a distinct payment structure:

5.1 Manual Job Posting — Card Payment via Website

For Manual Job Posting packages (Single Job Post, Growth Pack, For Big Guys), payment is made directly on the website at the time of purchase via credit or debit card. Accepted cards: Visa, Mastercard, and American Express.

Card payments are processed through Banca Intesa’s certified payment gateway (PCI-DSS compliant). Transactions are executed in Serbian Dinars (RSD). The RSD amount displayed on the bank’s payment screen is calculated based on the exchange rate applicable at the time of the transaction. The final amount charged to the Employer’s card may vary slightly from the USD price listed on the website, depending on the exchange rate applied by the Employer’s card-issuing bank on that day.

Kaymack publishes USD reference prices on its website and endeavours to set the RSD equivalent at or below that reference price. However, Kaymack does not guarantee an exact USD equivalent due to daily exchange rate fluctuations and does not adjust RSD pricing on a daily basis. The exact RSD amount will be clearly visible on the bank payment screen before the Employer confirms the transaction. By confirming payment, the Employer acknowledges and accepts the RSD amount charged.

Kaymack does not collect, view, store, or have access to any payment card data. All card information is transmitted directly to and processed exclusively by Banca Intesa’s payment system. Kaymack receives only a payment status notification (approved or declined).

5.2 Managed Services (Give me 5!) — Invoice and SWIFT Bank Transfer

For Managed Services packages (Give me 5! — Split Payment, Upfront Payment, and Full Cycle), payment is made via invoice issued by Kaymack DOO through the platform. Invoices are denominated in US Dollars (USD) and paid via SWIFT international bank transfer between two legal entities.

For the Split Payment option: the upfront instalment is due before sourcing begins. The second instalment becomes due immediately upon confirmation of a successful hire. A “successful hire” is defined as: a candidate from the Kaymack shortlist receiving and accepting the Employer’s offer of engagement. Managed service work begins only after the service agreement has been signed by both parties and the upfront payment has been received in full.

For the Upfront Payment option: the full amount is due before sourcing begins.

The 90-day replacement guarantee applies to all three managed service payment options. Full conditions of the guarantee are set out in the service agreement provided to the Employer prior to commencement of work.

Kaymack reserves the right to suspend or terminate service delivery without refund if the Employer fails to make payment by the due date stated on the invoice.

5.3 General Pricing Provisions

All orders are subject to the prices in effect at the time of payment confirmation. Kaymack reserves the right to change published prices at any time. Price changes do not affect orders already confirmed and paid. As all services are digital, there are no delivery costs.

6. RIGHT OF WITHDRAWAL, REFUNDS, AND PAYMENT DISPUTES

6.1 Right of Withdrawal

The Employer agrees that no right of withdrawal exists once a service has been fully performed, provided that performance commenced with the Employer’s express prior consent and with their acknowledgment that the right of withdrawal is forfeited upon full performance by Kaymack. This applies equally to services produced according to the Employer’s specific requirements.

For Manual Job Posting packages: once a job listing has been published and made active on the platform, the service is considered commenced and no refund is available.

For Managed Services: once sourcing has commenced following receipt of the signed service agreement and upfront payment, no refund of the upfront instalment is available. The second instalment of the Split Payment option is due upon successful hire and is non-refundable once paid.

6.2 Payment Disputes and Chargeback Policy

In the event of any dispute regarding a charge, the Employer is required to contact Kaymack directly at info@kaymack.careers before initiating any chargeback or payment reversal request with their bank or card issuer. Kaymack commits to responding to all payment dispute inquiries within 5 (five) business days.

Initiating a chargeback without first contacting Kaymack and allowing reasonable time for resolution constitutes a breach of these Terms. In such cases, Kaymack reserves the right to: (i) immediately suspend or terminate the Employer’s account and access to the platform; (ii) withhold any pending deliverables; and (iii) pursue recovery of the disputed amount and any associated costs through appropriate legal means.

Kaymack maintains records of all payment confirmations, service delivery milestones, and communications, which may be submitted as evidence in any payment dispute process.

7. USER OBLIGATIONS WHEN USING THE PLATFORM

The User must not use the website or Kaymack’s services in a manner that is contrary to the applicable laws of the Republic of Serbia or these Terms.

The User may not assign their username and account password to other persons.

The User is responsible for the security of their User Account, including their email address and password. Kaymack cannot and will not be liable for any loss or damage arising from the User’s failure to comply with this security obligation.

If the User loses their password or notices unauthorized use of their account, they must immediately notify Kaymack via the email address available on our website, so that the password is changed immediately and the subscriber is protected from further misuse.

By accepting these Terms, you agree to the following:

  1. Any unlawful, unauthorized, fraudulent, or misleading action is strictly prohibited.
  2. You may not perform any actions that could disrupt the operation of our website or other Platform Users, impair performance, collect information from the website by any means including automation, or similar.
  3. It is expressly prohibited to sell or transfer (with or without compensation) any part of your account (including your username), or to seek, collect, or use other users’ login credentials, or to attempt to do so.
  4. Any activity that is harmful, prohibited by law, indecent, offensive, harassing, hate-generating, or otherwise unacceptable is strictly prohibited.
  5. Any activity — or attempt thereof — to harm, misuse, harass, hack, threaten, or abuse the platform, in whole or in part, or other Users, is strictly prohibited.
  6. Any activity that may infringe or violate our rights or the rights of any third party in respect of intellectual property, personal data, reputation, or other rights is strictly prohibited.

Violation of these Terms or incitement of third parties to do so is not permitted. We advise you to report all violations to: info@kaymack.careers.

We may refuse to provide you with access to your account in whole or in part, including by disabling or terminating your User Account, without delay, in order to protect our rights, if we suspect that you are violating our rights, the rights of others, or the provisions of these Terms.

8. INTELLECTUAL PROPERTY

The website is the property of Kaymack.

All materials found on the website are the exclusive property of Kaymack.

Any copying, photographing, recording, distribution, transmission, sharing, publication, or otherwise making available to third parties, linking, adaptation, or alteration of website content without the express prior written consent of Kaymack is strictly prohibited.

Any use of the website contrary to the foregoing constitutes unauthorized use and will be considered a violation of Kaymack’s intellectual property rights, which may result in initiation of appropriate legal proceedings for copyright infringement, trademark infringement, or any other form of intellectual property violation.

9. LIABILITY

The User declares that they have accessed our website voluntarily and at their own risk.

Kaymack shall not be liable for any disruptions in the operation of the website, or any part thereof, if such disruptions, losses, or damages are caused by power outages or unstable electrical supply, computer failure, downloading, installation or use of software, improper use by the User, unauthorized or incompetent use of hardware and application software, computer viruses, or unauthorized access to the system via the Internet or otherwise.

Kaymack shall not be liable for any delays and/or failure to fulfill obligations arising from force majeure events or circumstances beyond its control, including but not limited to: war, terrorism, uprising, embargo, civil or military action, fire, flood, accidents, strikes, or other force majeure events that would jeopardize the operation of the website.

Kaymack may be liable exclusively for damages arising from the use or inability to use the website that were caused by its own fault or gross negligence.

10. CHANGES TO TERMS

Kaymack reserves the right to update, supplement, amend, and/or adapt these Terms at its own discretion.

If changes to these Terms occur, Users will be notified in a timely manner through notices published on Kaymack’s website.

The Terms are published on Kaymack’s website and enter into force 8 (eight) days from the date of publication.

If the User does not agree with the stated amendments, the Terms previously accepted by the User shall continue to apply to that User for the duration of the paid program.

11. DISPUTE RESOLUTION

Any disputes arising from the application of these Terms shall first be resolved by Kaymack and the User through amicable means.

In the event that an amicable resolution is not possible, the jurisdiction of the competent court in Novi Sad, Republic of Serbia, is hereby agreed upon.

12. NOTICE FOR U.S.-BASED EMPLOYERS

By purchasing services or registering as an Employer on Kaymack.careers, U.S.-based Employers explicitly acknowledge and agree that: (i) they are entering into a commercial services agreement with Kaymack DOO, a limited liability company (LLC) registered and operating under the laws of the Republic of Serbia; (ii) these Terms and all services provided hereunder are governed exclusively by the laws of the Republic of Serbia; and (iii) any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent court in Novi Sad, Serbia. By proceeding with registration or payment, U.S.-based Employers waive any right to invoke U.S. consumer or commercial law protections to the extent they conflict with this choice-of-law provision. This provision does not affect Kaymack’s obligations regarding the protection of personal data of Employer contact persons under applicable data protection law.

13. FINAL PROVISIONS

If any provision of these Terms is for any reason considered invalid or unenforceable, it shall be amended to the extent necessary to make it enforceable, and the remainder of these Terms shall remain in full force. If, however, it is determined that such a provision cannot be amended, it shall be deemed severable from the other terms and shall not affect the validity and applicability of the remaining provisions.

These Terms are drafted in English and shall be interpreted in accordance with the law of the Republic of Serbia. All matters not regulated by these Terms shall be governed by the relevant provisions of Serbian law.

CONSENT

BY SELECTING “ACCEPT” / “I AGREE”, THE USER CONFIRMS THAT THEY HAVE READ AND UNDERSTOOD ALL OF THE ABOVE PROVISIONS AND CONDITIONS, AND AGREES THAT THESE TERMS SHALL BECOME BINDING UPON THEM.
